Terms of Use — Data API & DataWidget®

1.Acceptance of these Terms

These Terms of Use ("Terms") are a binding agreement between you — the individual or business creating an account — and e-printwerx International LLC, an Arizona limited liability company, doing business as LeadsPlease® ("LeadsPlease", "we", "us"). By creating an account, ticking the "I agree to the Terms" box, accessing the Data API, embedding or using the DataWidget®, or ordering any data, you accept these Terms on behalf of yourself and the business you represent, and you confirm you have authority to do so.

2.The Services

These Terms cover the services we make available to account holders (together, the "Services"):

• The Data API — a REST/JSON interface for building audience criteria, obtaining counts, and ordering consumer, business, new-mover, and new-homeowner mailing lists and related data products.
• The DataWidget® — our patented embeddable mailing-list builder that you may place on your own website under an assigned affiliate code.
• The account portal — your dashboard, documentation, pricing, and account management pages.

Each account operates in one of two environments: Test (free evaluation with anonymized data — section 4) and Live (real, deliverable records with billing — section 5).

3.Your account

• You must provide accurate, current information at signup — including a real name, working email address, and phone number — and keep it updated.
• One account per business. Colleagues should share their company's account rather than registering separately. We may consolidate, merge, or close duplicate accounts registered by the same business.
• You are responsible for keeping your credentials confidential and for all activity under your account, including orders placed by anyone you share access with.
• Your personal dashboard link grants access to your account without a password — treat it like a credential and don't share it outside your business.
• You must be at least 18 and using the Services for business purposes, not as a consumer.

4.The Test environment

• Test access is free. Before we create your account, you must verify your email, accept these Terms and the data licence, and successfully verify a valid credit or debit card through Stripe. Card verification does not purchase credits.
• Test counts, previews, and list files are drawn from evaluation data and are anonymized: names and deliverable address fields are masked. Test data is provided so you can build and validate your integration — it is not usable, and not licensed, for any marketing purpose.
• Test access is subject to fair use. We may apply rate limits, usage caps, or expiration, and we may suspend or close Test accounts that are inactive, abusive, or used to circumvent these Terms.
• The Test environment is provided "as is", without any service-level commitment.

5.Going Live

Live access uses automated checks. To activate it you must provide your intended use and expected volume, accept the current Terms and data licence, verify a valid credit or debit card through Stripe, and fund your first prepaid credit pack. The current initial pack is $100 for 100 credits.

We activate Live access when the required checks and credit-balance synchronization succeed. Incomplete or failed checks do not grant access. We may restrict or suspend access for uses inconsistent with these Terms. Any separately required licence or reseller agreement must also be in place; this signup does not grant additional rights.

6.Fees, card on file & billing

• Card on file. Adding your card authorizes LeadsPlease® to keep it securely on file with our payment processor (Stripe) for purchases you authorize. Nothing is charged when the card is added.
• Prepaid data credits. Data API access uses prepaid credits: 1 credit represents $1 of data, valid for 12 months from purchase. You confirm the displayed price before purchasing a credit pack. There is no Data API subscription charge. Data orders draw from your available balance at the applicable rates; further credit purchases require your confirmation.
• Counts are estimates. A count is a point-in-time estimate of matching records; the billable quantity is the number of records actually delivered.
• Prepaid access has no monthly fee. The initial credit pack described in section 5 is required for Live access; you pay for the records you order.
• Rate changes. Your rates can be tailored to your account. We may change published rates with at least 30 days' notice; changes apply to orders placed after the notice period.
• Taxes are your responsibility where applicable.
• Refunds. Because lists are generated to your specification and delivered electronically, all sales are final once a list is delivered, except as required by law or expressly agreed in writing.

7.Data licence

Data is licensed, not sold. When a list or record set is delivered to you, LeadsPlease® grants you a limited, non-exclusive, non-transferable licence to use it — and every licence of LeadsPlease® data is granted by LeadsPlease® directly, even when you purchase through a reseller, white-label storefront, or embedded DataWidget®.

What the licence allows

• Use for your own (or, for agencies, your named client's) direct-marketing campaigns — mail, and where the fields and the law permit, email or phone outreach.
• Use for unlimited campaigns for twelve (12) months from delivery.

What it does not allow

• Reselling, sublicensing, renting, sharing, or publishing the data, in whole or in part, except under a separate written reseller agreement with LeadsPlease®.
• Using the data to build, enhance, or verify any database or data product offered to others.
• Retaining or using records after the licence term ends, except records that responded and became your own customers.

Delivered files may contain a small number of control ("seed") records that let us detect use outside the licence.

8.Compliance with marketing laws

You are solely responsible for using the data lawfully. Without limiting that, you agree to:

• CAN-SPAM — for any email use: truthful headers and subject lines, a working unsubscribe honored promptly, and your postal address in every message.
• TCPA & Do-Not-Call — for any telephone use: no calls or texts using an automatic telephone dialing system or prerecorded voice without the required consent; scrub against the National DNC Registry and applicable state registries; honor company-specific do-not-call requests.
• FCRA — LeadsPlease® is not a consumer reporting agency and the data is not a consumer report. You must not use it, in whole or in part, to determine any person's eligibility for credit, insurance, employment, housing, or any other purpose regulated by the Fair Credit Reporting Act.
• Fair housing & lending — no use of the data to discriminate unlawfully or to target or exclude protected classes in regulated advertising.
• Privacy laws — comply with applicable federal and state privacy laws (including the CCPA/CPRA and similar state acts) in your use, storage, and disposal of the data, and honor consumer requests you receive as required by law.
• Security — protect delivered data with reasonable safeguards and notify us promptly of any compromise.

9.Prohibited uses

You must not:

• attempt to re-identify, de-anonymize, or unmask Test data or any anonymized field;
• use the Services or data for anything unlawful, deceptive, harassing, or fraudulent, or to market products illegal where received;
• access the Services by any automated means that circumvents rate limits, or interfere with their operation;
• reverse engineer, copy, frame, or create derivative works of the Data API, the DataWidget®, or the portal, except as law permits;
• share, sell, or transfer your account, API credentials, or affiliate code without our written consent; or
• misrepresent your identity or use case to obtain access or approval.

10.Intellectual property

• The Services, including the DataWidget® (protected by U.S. Patent No. 12,482,026), the Data API, documentation, and all software, are the property of LeadsPlease® and its licensors.
• LeadsPlease® and DataWidget® are registered trademarks. These Terms grant no right to use our marks except as needed to identify the Services truthfully.
• Embedding the DataWidget® grants you a limited, revocable licence to display it on the domains associated with your affiliate code, unmodified.
• If you send us feedback or suggestions, we may use them without obligation.

11.Privacy

Our handling of the personal information you give us at signup (name, email, phone) is described in the LeadsPlease® Privacy Policy, published alongside these Terms. We use your contact details to operate your account, provide support, and send service and onboarding emails; you can opt out of marketing messages at any time.

12.Disclaimers

Marketing data is compiled from many public and proprietary sources and changes constantly. Except for any guarantee we state expressly in writing, the Services and all data are provided "as is" and "as available", and we disclaim all other warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that data will be complete, current, deliverable, or error-free, or that the Services will be uninterrupted.

13.Limitation of liability

To the fullest extent permitted by law: (a) neither party is liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or revenue; and (b) our total liability arising out of the Services or any data will not exceed the amounts you paid us in the twelve (12) months before the event giving rise to the claim (or US $100 if you have paid nothing). These limits do not apply to your payment obligations, your breach of sections 7–9, or either party's liability that cannot be limited by law.

14.Indemnification

You will defend and indemnify LeadsPlease® and its officers, employees, and agents against any third-party claim, fine, or proceeding arising from your use of the data or the Services, your marketing campaigns, or your breach of these Terms — including any claim under the marketing and privacy laws in section 8.

15.Suspension & termination

• You may close your account at any time by contacting us; accrued fees remain payable.
• We may suspend or terminate access immediately where we reasonably believe you have breached these Terms, your card cannot be charged, or your use creates legal or reputational risk — and otherwise on reasonable notice.
• On termination your API credentials and affiliate code are deactivated. Licences to data already delivered survive for their term unless termination was for your breach, in which case they end immediately and you must delete the data.
• Sections 7–14 and 17 survive termination.

16.Changes to these Terms

We may update these Terms from time to time. For material changes we will give at least 30 days' notice by email or in the portal. Continued use of the Services after the effective date of an update is acceptance of the updated Terms. The current version is always available at this page.

17.Governing law & contact

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. The state and federal courts located in Maricopa County, Arizona have exclusive jurisdiction, and each party consents to venue there. If any provision is unenforceable, the rest remain in effect; our failure to enforce a provision is not a waiver.
